I know that running a road race is a potentially hazardous activity, which could cause injury or death. I will not enter and participate unless I am medically able and properly trained. By my signature, I certify that I am in good health, have not been advised by a physician or other medical provider not to participate in this, or a similar event, or physical activity, and I am properly trained for each and all of the events I am entering. (If in doubt as to your physical condition to engage in an event as strenuous as these races, it is strongly recommended that you seek the advice of a competent physician.)
I agree to abide by any decision of a race official, including law enforcement officials, relative to any aspect of my participation in this event, including the right of any official to deny or suspend my participation for any reason whatsoever. I attest that I have read the rules of the race and agree to abide by them.
As a condition to participation in this event, I assume all risks associated with or relating to participation, including, but not limited to: falls; potentially injurious physical contact with other participants, volunteers, race personnel, contract service providers, employees, spectators or objects that will or may be located on the race course, such as barricades or other traffic or crowd control devices, timing mats, aid station tables, or service vehicles; hazardous conditions of the roadway, shoulders and sidewalks or other public areas on and around the race course or pre or post-race event venues; the effects of weather on participants and/or the course (including but not limited to high or low temperatures, rain or wind); any acts of violence that occur at or during the event; and the potential of contracting a communicable disease, including 2019 Novel Coronavirus Disease (COVID-19), associated with contact, or being in close proximity, with other participants, volunteers, race personnel, contract service providers, employees, and spectators.
I understand and acknowledge that the Tampa Warriors Hockey Program Inc (“TWHP”) cannot fully protect me from or against the risks associated with this event, including the possible exposure to communicable or infectious diseases.
I further agree to abide by the Center for Disease Control’s (CDC) recommendation for the prevention of the spread of COVID-19 and other communicable diseases that are or may be in place as of the date of the event, and I attest to having read the CDC’s current guidance at: https://www.cdc.gov/coronavirus/2019-ncov/communication/guidance-list.html?Sort=Date%3A%3Adesc
In consideration of my entry being accepted in the Tampa Warriors St. Patrick's Day 5k Ru/Walk, I, intending to be legally bound, do hereby, for myself, my heirs, executors, and assigns, waive, release and forever discharge any and all rights and claims for damages that I may have or which may hereafter accrue to me against TWHP, or any subsidiary or subdivision thereof, it’s or their respective officials, agents, representatives, volunteers, insurers, successors, assigns and event sponsors (the “Released Parties”) from all claims or liabilities of any kind arising out of or relating to my participation in the Tampa Warriors St. Patrick's Day 5k Run/Walk, even though that liability may arise out of negligence or carelessness on the part of the Released Parties.
I understand that bicycles, skateboards, roller skates or inline skates, animals, and personal music players are not allowed in the race, and I will abide by all race rules.
I also understand that in the event the Tampa Warriors St. Patrick's Day 5k Run/Walk cannot be held as scheduled because of COVID-19 or another public health event, an act of God, or circumstances beyond TWHP’s control, including the issuance of any executive, county, municipal or judicial order, law or rule, the Tampa Warriors St. Patrick's Day 5k Run/Walk will be canceled and I will be entitled to a partial entry fee refund or partial entry fee deferral to the next year's event.
I grant the Released Parties permission to use my photographs, motion pictures, images, likeness, recordings, or any other record of this event for any legitimate purposes, including for commercial purposes, without compensating me.
I also hereby consent to permit emergency treatment in the event of injury or illness. TWHP reserves the right to reject entry for any reason.
I understand all persons under 18 years of age must have the written consent of their parent or legal guardian to compete in the abovementioned events.
I, the undersigned parent, or guardian, hereby consent to the applicant's participation and waive and release all rights and claims for damages as is more fully set forth above.
WAIVER: I, the undersigned participant (and my parent or guardian if I am younger than 18 years of age), intending to be legally bound, do hereby forever release and waive any and all rights, claims, and actions for damages that we, our heirs, executors, administrators, and assigns may have, or that may hereafter accrue against any and all persons, organizations, and other entities associated with the event, including, but not limited to Race Entry, sponsors, affiliates, volunteers, Tampa Warriors St. Patrick's Day 5k Run/Walk, and individual Tampa Warriors St. Patrick's Day 5k Run/Walk organizers, arising out of or in connection with my involvement before, during, or after the event.
I verify that I am physically fit and sufficiently trained to participate in this event and I assume the risks involved in this activity. I further attest that I will be mindful of traffic along the race course, and hold said sponsors and organizers blameless in any harm that may happen.
I consent to the collection and use of my Personal Information as contained in the Privacy Policy. I also give my permission for the free use of my name and/or pictures in telecasts, broadcasts, newspapers, posters, advertising, etc.
I also acknowledge understanding that the charge to my card will show up as Race Entry. I acknowledge that the online processing fees and charitable donations are non-refundable. I also acknowledge that any charitable donations will have 4.97% withheld from the donation to pay credit card and administrative costs.
Race Entry shall not be liable to you for any direct, indirect, special, incidental, consequential or exemplary damages including, but not limited to, loss of profits, goodwill, use, data or other intangible loses. Race Entry does not guarantee the completeness or accuracy of any information contained in, or provided in conjunction with the http://www.raceentry.com website. Race Entry is not responsible for any omissions or inaccuracies, or for the results obtained from this information.
Race Entry facilitates registration for various events, some of which allow participants under the age of thirteen (13). We require a submission of birth date for all registration entries. For children under the age of thirteen (13), parental or guardian consent is required.
You agree that the statutes and laws of the State of Utah, USA, will apply to all matters relating to this Agreement and Waiver. You irrevocably consent that exclusive jurisdiction for any dispute with Race Entry relating to this Agreement and Waiver resides in the courts of Utah, and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of Utah in conjunction with any such dispute including any claim involving Race Entry .
